When naming my children do I have to include Stepchildren?

You should only list stepchildren if you have legally adopted them.

Who cannot be my Executor?

A minor or anyone convicted of a criminal offence. You would usually appoint someone as an Executor who lives in the country that Will applies to.

Can my Executor be a beneficiary?

Yes they can.

What does an Executor do?

They are responsible for administering your estate which includes things like collecting assets, paying debts and taxes and ensuring the remaining assets are distributed in accordance to your Last Will.

Can I appoint Wills4Expats to act as Executor of my Spanish Will?

Wills4Expats is part of White Doves Funeral Planning who can act as the Executors of Spanish Wills for our clients. At the time the Will is executed, we will deal with probate on behalf of your estate. The fee payable for us to execute your Spanish will is 1.75%, plus IVA, of the value of the estate, this includes the services of our specialist solicitor. Additional costs may be incurred, such as notary fees, land registry fee, etc

What is a Main Beneficiary?

This is the person who will receive everything in your Estate on your death if they are alive when you die. It would be advisable to name replacement beneficiaries in case your main beneficiary dies before you. Please see Replacement Beneficiary FAQ below for more detail.

Can I have more than one main beneficiary?

Yes. You can have whoever you wish to be your main beneficiary and there is no restriction on the number of beneficiaries. If you would like to name more than one person as your main beneficiary to receive inheritance on your death then that is possible. To do this please complete the Contact Us Form and a member of the Wills4Expats team will contact you.

Can I leave my estate in part or full to a Charity?

Yes, you can leave any part of your estate to a registered Charity in the country where the asset is. You will need to provide the Charity number. Please email us at admin@wills4expats.com and we can take care of that request in your Will document.

What is a replacement beneficiary?

These are the people who will inherit your estate if your main beneficiary dies before you.

Can I have more than 3 replacement beneficiaries?

Yes. You can have whoever you wish to be your replacement beneficiary and there is no restriction of the number of beneficiaries. If you would like to name more than 3 replacement beneficiaries, please complete the Contact Us Form and a member of the Wills4Expats team will contact you.

Why do I have to name the person I wish to exclude from my Will?

By naming the family members you wish to be excluded from your Will it shows that you have not forgotten them making any future contesting of the Will more difficult.

Why do I have to give a reason for excluding them?

The reason given will not appear on the Will document but will appear on a Memorandum of Wishes so that in the event of any contentious issues when your Will is executed your Executor knows why you did not want them to benefit from your estate.

Do I have to specify if I want to be buried or cremated?

No you can leave the answer field blank if you are undecided or have no preference. However, If you know what you would like then you should state that so that your Executor complies with your wishes.

What can I list in specific gifts?

You can include a small number of specific items to be passed to specific people. For example, you can state who would you like to take care of your pets or who would you like to receive a specific gift such as a ring that has sentimental value These will be noted on a Memorandum of Wishes and your Executor can comply with these wishes.

Why do I have to give an alternative beneficiary of gifts?

If the person you have named is unable or unwilling to accept them they will go to the replacement you name.
